Open Letter From Conservative Leaders: The President Can and Should Lead on Obamacare

The continuing lack of leadership on repealing Obamacare makes Presidential action critical and timely. The President has the authority to move the process of repeal forward and show that he aims to keep his word. To that end, we recommend he immediately take the following steps.

• Take direct action to end the illegal and unconstitutional cost-sharing subsidies to the insurance companies, implemented by the Obama administration. Lower courts have declared these subsidies to be unconstitutional; the Trump administration should follow their rulings and halt their disbursement.
• Delegate the majority of Obamacare’s rulemaking authority to the states, by directing the Health and Human Services Department to more actively use their waiver authority.
• Begin fixing the skyrocketing costs of Obamacare premiums by more narrowly defining what constitutes mandated benefits. Requiring individuals to pay for low-cost preventative care themselves will allow more federal resources to be directed to the very sick, and lower costs for participants across the board.
• Continue to fight for repeal of the individual mandate.
• Correct the improper designation of Congress and their staff as a “small business,” which it is clearly not.  End the 70 percent subsidy which they have been receiving.
• End the illegal diversion of money from the US Treasury to insurance companies. The transfer of this money, initiated by the Obama administration, was found to be illegal by the Government Accountability Office in September 2016. President Trump should halt these payments immediately, and require the insurance companies to restore the money to the Treasury.
• Expand the exemption for so-called “grandmothered plans, with the goal of allowing more options of consumers across the board. States should be allowed the option to create a free-market for health care, should they choose.

These executive actions are necessary steps to begin the promise of full repeal of Obamacare. Until Congress acts, President Trump must take executive actions to reduce the damage that millions of Americans will continue to suffer under the Unaffordable Care Act.
