Lest anyone miss the point, this is the whole issue now that Roe is gone. The 14th Amendment is clear: no one may take life, liberty or property without due process of law. What law has the infant broken, that he or she would be guilty unto death? So if they are legally recognized as persons within the meaning of the 14th Amendment, abortion is gone.
And in fact, that would not have been even slightly controversial in 1868 when the 14th was ratified. Abortion was rightly illegal throughout the United States because everyone understood that the unborn infant was a person. It was and is so obvious that no one needed to make a law about it.
That clarity has been lost. So we must amend our laws. And from here on in, that's the battle.
